EU Human Rights Court Gives 25k EUR To Prostitute Killer

This is the prostitute-killing rapist set to pocket 25,000 EUR after he was unfairly jailed in the maximum security wing of a prison, following a ruling by the European Court of Human Rights.

The European Court of Human Rights (ECHR) in the French city of Strasbourg found in favour of the convicted prostitute killer only identified as Tobi B. in the case against the Swiss state.

The court ordered the Swiss state to pay 25,000 EUR (21,497 GBP) in damages to the criminal.

Tobi B., now 30 years old, was sentenced to four years in jail for the premeditated murder and aggravated rape of a prostitute in November 2011.

A Swiss juvenile court supplemented his sentence with a protection measure by placing him in the high-security wing of a specialised closed centre to undergo treatment for mental disorders between April 2014 and April 2015.

Tobi B., however, fought this measure at the Swiss courts, going all the way to the Federal Swiss Supreme Court.

Switzerland’s highest court ruled against Tobi B., saying that he “represented a high risk for others” and that the Civil Code provided a sufficient legal basis for placement “for assistance purposes”, which is a special measure for people with mental disorders who require personal assistance or treatment that could only be provided in a specialised institution.

The prostitute killer lodged a final appeal at the ECHR, which has now ruled that his record shows that the man does not pose such a serious and acute danger to detain him on such grounds.

In a press release, the ECHR wrote: “The mere need to protect society from the person concerned could not justify placement ‘for assistance purposes’.” 

The court concluded that Tobi B. “had been held in the prison without a legal basis and purely by way of preventive detention” during the one year he spent in the high-security wing of a specialised closed centre.

It wrote: “In conclusion, the Court took the view that the applicant’s placement ‘for assistance purposes’ during the period from April 2014 to April 2015 in the prison’s security wing had not been implemented lawfully.”

As well as the 25,000 EUR in damages, Tobi B. will also receive 7,000 EUR (6,021 GBP) as compensation for non-specified costs and expenses he incurred.

Tobi B. has lived in an external institution since September 2018.
